Subject: Reporting under Article 9 of Regulation EU 648/2012 as amended (‘EMIR’) – Wind down of CME Trade Repository Ltd (‘CME’)
Purpose: To draw the attention to the obligation to comply with EMIR Reporting requirements at all times and inform about the wind down of CME.
In Summary:
CySEC has issued the Circular C413 on 05/11/2020 in order to draw the attention of Cyprus Investment Firms, UCITS and Management Companies, Alternative Investment Funds managed by AIFMs, Non-Financial Counterparties and Central securities depositories to their obligation to comply with their EMIR Reporting requirements at all times.
Furthermore CySEC informs that taking into account the wind down of CME, the above Regulated Entities are encouraged to take urgently the necessary action in order to ensure their timely porting to an alternative EMIR trade repository.
CySEC notes that Regulated Entities not complying with their EMIR reporting obligation will be subject to enforcement action.
