Subject: Clarifications on the data to be submitted regarding Recommendation 2022/9 of the European Systemic Risk Board (ESRB) on the vulnerabilities in the commercial real estate sector in the European Economic Area
Purpose: To provide clarifications to Regulated Entities for the submission of the Form CRE – IF.
In Summary:
CySEC has issued the Circular C621 on 08/02/2024 to provide clarifications to Alternative Investment Fund Managers (‘AIFMS’), Internally Managed Alternative Investment Funds, UCITS Management Companies, Internally Managed UCITS, Internally Managed Alternative Investment Funds with Limited Number of Persons (‘AIFLNP’), Companies with sole purpose the management of AIFLNPs and Small AIFMs, for the submission of the Form CRE – IF, relevant to the Recommendation 2022/9 of the European Systemic Risk Board (ESRB) on the vulnerabilities in the commercial real estate sector in the European Economic Area.
This Circular C621 is issued following the Circular C617 that was issued on 24/01/2024.
CySEC informs that the Form CRE – IF (the “Form”) should be completed and submitted only by sub-funds/funds that were active at 30/06/2023 (the “reference date”). In particular, a sub-fund/fund that had not raised capital as at the reference date, is not obliged to submit the Form.
This Circular C621 also clarifies for the information to be completed in the Index section of the Form.
CySEC further informs that for the current submission procedure, the Form must not be digitally signed.
CySEC notes that, related to the filename, the format indicated in Circular 617 must be followed.
The Form must be submitted through the TRS.
