Subject: Electronic Cross-Border Form, Freedom to Provide Investment Services and Activities (‘Cross Border Activity’)
Purpose: To provide detailed information to CIFs regarding the obligation to submit the Electronic Cross-Border Form.
In Summary:
CySEC has issued the Circular C757 on 25/02/2026 to provide detailed information to the Cyprus Investment Firms (CIFs) regarding the completion and submission of the Electronic Cross-Border Form (online questionnaire) via EU’s online platform. This Circular is issued following CySEC’s Circular C754 issued on 09/02/2026.
The information included in Circular C757 is addressed to CIFs that fulfil the conditions set out in point “1.1” of Circular C754, which refer that the Cross-border online questionnaire must be completed by CIFs that were authorised by 31/12/2025, and which have provided cross-border services to more than 50 active retail clients, (including clients treated as professionals on request according to Section II of Annex II of MiFID II) (therein ‘retail clients’), in at least one host Member State. More details can be found under Paragraph “1.2” of Circular C757.
Information collected through the Cross-border online questionnaire on the CIFs’ cross border activity refers to the reporting period 01/01/2025 – 31/12/2025 and reference date 31/12/2025, as relevant.
CySEC informs that an email with the link and password to access the online questionnaire will be sent out to all CIFs that fulfil the conditions set out in point “1.1” of Circular C754.
CySEC notes that participating CIFs must complete the online questionnaire and submit their contribution for each host Member State that qualifies under Paragraph “1.2” of Circular C757, by 27/03/2026, at the latest.
CySEC further notes that upon successful submission of the Form, the message “Contribution successfully submitted” and a contribution ID will be populated on the screen. CySEC advice CIFs to save the contribution ID for each Member State, for reference purposes.
Furthermore, CySEC informs CIFs that upon submission of their contributions, CIFs are required to notify CySEC by sending an email to riskstatistics.cifs@cysec.gov.cy, specifying, for each host Member State, the number of complaints directly attributable to AML/CFT obligations, out of the total number of complaints declared in the relevant contribution for that Member State.
Circular C757 includes details regarding important changes compared to past exercise, specific instructions for the completion of the Online Questionnaire and other useful information.
