Subject: Recommendation 2022/9 of the European Systemic Risk Board (ESRB) on the vulnerabilities in the commercial real estate sector in the European Economic Area – annual data collection
Purpose: To remind all Regulated Entities that the "Form CRE – IF"  must be completed and submitted on an annual basis.

In Summary:

CySEC has issued the Circular C761 on 18/03/2026 to remind the Alternative Investment Fund Managers (‘AIFMs’), Internally Managed Alternative Investment Funds, UCITS Management Companies, Internally Managed UCITS, Internally Managed Alternative Investment Funds with Limited Number of  Persons (‘AIFLNP’), Companies with sole purpose the management of AIFLNPs and the Small AIFMs, that the Form CRE – IF (the “Form”) should be completed and submitted on an annual basis.

The Form must be completed and submitted only by sub-funds/funds that were active at 31/12/yyyy (the “reference date”) and domiciled in Cyprus. In particular, a sub-fund/fund that had not raised capital as at the reference date, is not obliged to submit the Form. It is important to note that Regulated Entities must complete a separate Form for different sub-funds/funds. In case a sub-fund/fund has nothing to report in the Form, the Form should be completed with zero figures. 

Circular C761 is issued following Circulars C617, C621, C739 and the adoption of Recommendation ESRB/2022/9 issued by the ESRB on 01/12/2022 on the vulnerabilities in the commercial real estate sector in the European Economic Area (the ‘Recommendation’).

Deadline for the submission of the Form is by March 31 of each year.

The Form must be successfully submitted electronically, via CySEC’s Transaction Reporting System (‘TRS’).

Circular C761 also refers to the method of creating and submitting the Form to CySEC and includes General Comments for the Form, informing among others about the information to be collected and the reporting reference dates/periods.
